Arden Wayne Foster, 50, has been charged with assault in the fourth degree with sexual motivation.

Foster, a resident of Eastound, is accused of assaulting his roommate’s daughter in mid-December. His arraignment was on Jan. 4 in San Juan County District Court. His pre-trial hearing is on Feb. 8.

The victim, who is 17, told deputies she was alone in the house on Dec. 15 with Foster, who was drinking and smoking marijuana. The two were sitting on the couch together when he allegedly moved his hand towards her breast and began rubbing her hip. He then moved his hand two inches from her vagina, while rubbing her leg. When the victim asked him what he was doing, he allegedly replied: “Oh, am I going to get into trouble?” and then went in her room. He texted her the next day to apologize.

The morning after the incident, the victim told her teacher. She said she’d first been molested by Foster when she was nine, but did not report it. On Dec. 17, a deputy questioned Foster, and he said while he remembered sitting shoulder to shoulder while watching videos with the victim, nothing inappropriate occurred. According to the deputy’s report, Foster said he “may have rested his arm for a second, but not in that way at all.”

Foster’s previous convictions include driving under the influence and assault.
